These Terms of Use ("Terms") govern your use of the mobile games published by Emotion Factory, including Tile Journey, and of the website at emofactory.io. By downloading, installing or playing our games you agree to these Terms. If you do not agree, do not use the games.
"We", "us" and "our" refer to that entity, trading as Emotion Factory.
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and play our games on devices you own or control, for your own private entertainment. You may not copy, modify, distribute, sell, rent, sub-license, reverse-engineer or create derivative works from the games, except to the extent the law expressly allows it despite this restriction.
You must be at least 13 years old, or the minimum age required in your country, to use our games. If you are under the age of majority where you live, you may use them only with the involvement of a parent or guardian, who accepts these Terms on your behalf.
Do not cheat, exploit bugs, use unauthorised tools, emulators, bots or automation, tamper with game files or network traffic, or interfere with the games or other players. Do not use our games for anything unlawful. We may suspend or terminate access for violations.
Our games may offer optional in-app purchases of virtual currency or items. Virtual items are licensed to you, not sold. They have no real-world value, cannot be exchanged for money or anything outside the game, and may be changed, rebalanced or discontinued as the game evolves.
All purchases are processed by the Apple App Store or Google Play under their own terms. We never receive your payment details. Refunds are handled by the store you bought from, under that store's policy. If you live in the EU or another jurisdiction with a statutory right of withdrawal, that right applies as the law provides, and the store handles it.
If you delete a game or lose access to your device, virtual items and progress may be lost. Because our games have no accounts, we cannot always restore them.
Our games may show advertising, including rewarded ads you choose to watch. Ads are supplied by third parties and we do not control their content. How advertising relates to your data is described in our Privacy Policy.
The games — including art, code, music, sound, characters, level design, and the Tile Journey and Emotion Factory names and logos — are owned by us or our licensors and protected by intellectual-property law. Nothing in these Terms transfers any of those rights to you.
If you create videos, screenshots or streams of our games, you may share them, including on monetised channels, as long as you do not claim the game as your own, do not distribute the game files, and do not imply we endorse you.
We may update, change or discontinue a game or any of its features at any time. Some features require an internet connection and may be unavailable in some regions. We do not promise that a game will always be available, uninterrupted or error-free.
Our games are provided "as is" and "as available", without warranties of any kind, to the extent the law allows. To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, or for lost progress, lost virtual items or lost profits, arising from your use of the games.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law — including liability for death or personal injury caused by negligence, for fraud, and your statutory rights as a consumer.
You may stop using our games at any time by uninstalling them. We may suspend or end your access if you breach these Terms. Sections that by their nature should survive termination — intellectual property, disclaimers, liability — continue to apply.

These Terms are governed by the laws of the Republic of Serbia, without regard to conflict-of-law rules. If you are a consumer, this does not deprive you of the protection of the mandatory consumer law of the country where you live, and you may bring proceedings in your local courts where the law gives you that right.
We may update these Terms from time to time. Continued play after an update means you accept the revised Terms. The current version always lives at this address, with the date at the top.
